Saturday morning appointments at our Hartlepool office

Coronavirus Arrangements Notice

At the present time all our offices remain open to give advice and help to new and existing clients in relation to any of your legal needs.

 

The health of our staff and clients is extremely important to us. TMJ are complying with Government and Public Health England guidelines in relation to attendance at our offices. In accordance with the guidelines, we are requiring staff members and others to remain away from our offices for 14 days if they have a new continuous cough and/or a high temperature

 

We would ask that you do not attend our office if you have, or anyone you have had contact with, has visited a high risk area within the past 14 days, or if you or anyone you live with are displaying symptoms of the virus. and to follow the stay at home guidance.

 

We are making immediate arrangements for our staff where possible to work from home. We will continue to open all of our offices for as long as it is safe to do so. We are recommending that our staff use telephone, conference call or online meeting facilities wherever possible, with immediate effect.

 

We would encourage clients to communicate with us electronically and to request telephone or skype/facetime appointments wherever possible.

 

We request that those clients who wish to visit our offices confirm they are fit and well to do so and take all necessary sanitary precautions before visiting us.

 

We are continually monitoring the current health situation and should it become necessary for health reasons to close our offices for face to face appointments our team will continue to deal with your legal affairs promptly and efficiently via secure remote working technologies.

New Electrical Safety Standards for Landlords

Posted: 18th February 2020

Under new regulations from 1st July 2020 (for new tenancies) and 1st April 2021 (for existing tenancies), landlords will be required to provide electrical installation inspection reports every five years, providing a copy to all tenants with 28 days of the inspection. Landlords must also retain a copy until the next inspection. 

Breaches of the new regulations could result in huge penalties of up to £30,000.00 for landlords.

Wills and Estates : Fact or Fiction?

The TMJ Legal Services Private Client Department have recently been discussing some of the most common myths and misunderstandings about Wills and we have shared some of our favourites below. How many of these did you know?

 

False - There is no “reading” of the Will.

Often in TV shows and films you will see a family gather in a badly lit, wood panelled room to hear a rather stoic solicitor read the deceased’s Will; - usually leading to shocking gifts of the deceased’s fortune to a wayward relation, or the revelation of bizarre conditions requiring some unfortunate soul to spend the night in a haunted house?

In reality there is no “reading” of the Will in this fashion. A Will remains a private and confidential document until the Grant of Probate or Grant of Letters of Administration has been made, so no solicitor would divulge the contents to anyone apart from the Executor of the Will before this point.

 

False - Wills are only for rich people with money to leave to others.

Making a Will is an inexpensive process which takes into account much more than just who you want to inherit your wealth. Having a Will also gives you the opportunity to declare whether you wish to be buried or cremated, nominate guardians for your children should the worst happen, and appoint trusted executors to administer your estate. It is even possible to make provision for the care of pets. A Will is also a chance to give instructions for sentimental and cherished items to be left to the loved ones who would most appreciate them.

 

False - Wills can’t be challenged.

While an expertly drafted Will is less likely meet with a challenge, Wills which have been drafted without legal advice or by one of the many unregulated Will writing firms could be challenged, potentially leading to expensive Court visits, family arguments and failure of the Will. Out of date wills can also be challenged, so it is very important to review and update your Will if your circumstances change.

False - Wills affect jointly owned property, savings, and life insurance policies.

If you have property owned with another living person as beneficial joint tenants, own property in a trust with others, or have a joint bank account, all these will pass to the survivor regardless of what your Will might say. This is known as the “doctrine of survivorship”. If you have nominated a beneficiary to your life insurance proceeds, this will also be unaffected by your Will.  Wills also don’t determine who benefits from assets held in trust.

If you are unsure about how you hold your property, please contact us and we will conduct a completely free “Property MOT” for you, which involves checking the title deeds to your property to see whether you hold it as beneficial joint tenants or otherwise. We can also advise you on other ways to hold property which may be more appropriate depending on your age, family situation and financial circumstances.

An experienced Solicitor is required to join a highly regarded and established firm with offices in Hartlepool, Peterlee, Wingate and Durham. 

The firm is looking for an experiencved, proactive, ambitious litigator to advise on General Civil Litigation (e.g. property disputes, commercial contract claims, partnership/shareholder disputes, consumer claims, contentious probate, boundary disputes). Experience of advising on employment law issues would also be an advantage.

Candidates must have the ability to run a caseload from start to finish and you will have sound knowledge and a proven track record. You will have excellent communication and organisational skills. You will be a committed and self-motivated individual who can work as part of a friendly team, to tight deadlines and have excellent attention to detail. You will be required to have a good understanding on the Civil Procedure Rules and Civil Litigation generally.
