Family Law Mediation
Family Mediation is a form of dispute resolution that aims to help parties understand each other’s point of view and reach an agreement on family law issues with the assistance of a mediator.
Mediation can help resolve disagreements regarding finances upon breakdown of a relationship or regarding child arrangements. In some cases, it can be a very efficient and cost-effective way of settling disputes.
In most cases, there is now a requirement for mediation to be attempted before a party makes an application to court. This is to try and avoid court proceedings being issued unless absolutely necessary. However, there are some exemptions to this requirement, such as in some cases or urgency or where there has been domestic abuse between the parties.
Upon making a referral to mediation, both parties will be invited to attend an initial individual appointment with the mediator, called a Mediation Information Assessment Meeting (MIAM). The mediator will then assess whether mediation is suitable in your case.
If an agreement is reached during mediation, a member of our Family Department can then assist to draw up a Settlement Agreement, financial Consent Order or Child Arrangements Agreement reflecting the agreed terms. This can be signed by both parties and, if necessary, filed with the court for consideration and approval by a judge. We can also assist with negotiating any remaining issues that are still not agreed following mediation and advising on the implications of the terms agreed.
