Why enter a Clean Break Order when you believe there are no matrimonial assets?
As mentioned when I explored the financial implications of re-marriage after divorce, we would always advise you to deal with financial ties as part of your divorce proceedings, even if you believe there are no assets of the marriage. If you don't, then at any point, up until your former spouse remarries, they can start financial remedy court proceedings.
This means that if your assets have significantly increased since the divorce, your former spouse could try and acquire some of these as part of financial proceedings. Entering into a clean break order prevents your former spouse from being able to make any future claims.
If you would like assistance with preparing the necessary documents to enter into a Clean Break Consent Order, please do not hesitate to contact enquiries@tmjlegal.co.uk or telephone 01429 235 616 to speak to a member of our Family Department.
